It is proposed to increase the damage limit at which an accident can be registered without employees of the State Traffic Inspectorate to 300 thousand rubles. The relevant amendments to the law "On OSAGO" were developed by deputies of the State Duma. Insurers and experts have mixed opinions about this proposal. Where there are 200, there are 300

Amendments to the law "On CTP" have been submitted to the State Duma, providing for an increase to 300 thousand rubles in the limit of damage caused in an accident, in which an accident can be registered according to the European protocol. The document has been published in the legislative support system of the Parliament.

This limit was already increased in July from 100 thousand rubles to 200 thousand rubles, the authors of the bill remind, emphasizing that it had not been reviewed before for more than five years. However, due to rising car prices, "the current limit on payments under the European protocol ceases to correspond to the real level of damage in an accident," the parliamentarians believe.

"The projected increase in the cost of vehicles as a result of the new recycling calculation methodology will, in turn, lead to a significant increase in the cost of car parts and repairs. Accordingly, in the event of an accident, even minor damage repairs may exceed the current limit, which will force victims to contact the State Road Safety Inspectorate of the Ministry of Internal Affairs of the Russian Federation more often, increasing the burden on the police and creating traffic congestion. Given that the Euro protocol is issued in more than 40% of accidents, an insufficient limit due to rising prices may reduce its use," the explanatory note to the bill says.

Increasing the limit to 300 thousand rubles will help maintain the effectiveness of the simplified procedure for registration of road accidents and protect the interests of citizens, the authors of the amendments are confident.

Lifting is impractical

According to the Russian Union of Motor Insurers (RSA), for eight months of this year, 511 thousand accidents were registered under a simplified procedure without involving traffic police officers, which is 41.2% of all applications for CTP compensation. The European protocol was most often used in Moscow (44,091 cases), Moscow (28,447), Novosibirsk (21,852), Chelyabinsk (16,797), Samara (15,425), Sverdlovsk regions (14,438), St. Petersburg (15,824), as well as in Bashkiria (16,340), Tatarstan (13,438) and Primorsky Krai (18,225). However, the proposal to raise the limit on the European protocol to 300 thousand rubles is considered excessive in the RSA.

— As of today, there is no information in the RSA indicating that the previous increase is insufficient. On September 19 of this year, updated reference books were put into effect, which do not show significant changes in prices for spare parts in Russia. Any change in payment limits must be economically justified and accompanied by a change in tariffs," the press service of the RSA told Izvestia.

The union said that at the moment the average CTP payment is 103 thousand rubles for cases of damage to the vehicle, and 78.5 thousand rubles for cases where a European protocol has been issued. Thus, the existing compensation limit for cases where the participants in an accident have disagreements and a European protocol has been issued is sufficient for today and it is impractical to increase the maximum amount of payments in these conditions, according to the RSA.

"In the event of a significant change in the cost of vehicles and an increase in the cost of spare parts, as well as the cost of servicing vehicles, this issue will need to be approached in stages and in conjunction with other changes in the field of CTP insurance, having previously assessed all the consequences for car owners and the insurance market," the union's press service emphasizes.

The proposed bill applies only to accidents registered under the European protocol, in which there are disagreements between the participants in the accident regarding the circumstances of the injury, the nature and list of damages, the RSA notes. There are very few such events: less than five hundred cases over the past 12 months, which is less than one tenth of one percent of all events, the union stressed.

— After the introduction of a similar amendment to the CTP law, which entered into force on July 5 this year, the monthly number of such events has increased, although their share remains extremely small. At the same time, we note a slight increase in interest in registration under the European protocol, as this topic is increasingly being discussed in the media. Unfortunately, we note a particular increase in such interest from fraudsters, and this increases the volume of illegal payments. And for conscientious car owners, the possibility of the previous amendment to increase the limit to 200 thousand. rubles are still far from exhausted, according to the RSA.

Analysis is needed

The opinions of experts on the need to increase the damage limit on the European protocol differed. Raising this threshold will increase the number of accidents that can potentially be registered without the participation of traffic police officers, said Valery Soldunov, a member of the Civic Chamber of the Russian Federation and chairman of the All-Russian Society of Motorists.

— It's no secret that there aren't enough traffic police inspectors. Increasing the limit at which an accident can be registered without police officers will make it possible not to distract traffic inspectors to accidents in which there are no injured people. Accordingly, they will be able to arrive faster at serious accidents where they are really needed. And participants in a small collision will have an additional opportunity to arrange such an accident on their own, without blocking the road while waiting for the police," Valery Soldunov told Izvestia.

The deputies' proposals will make it possible to relieve traffic inspectors, Igor Morzharetto, a member of the presidium of the Public Council under the Ministry of Internal Affairs of the Russian Federation, agrees. However, the existing limits, as the statistics of insurers show, are quite enough to register most minor accidents without police officers, he notes.

— This limit has already been raised quite recently. Proposals for another increase should be based primarily on an analysis of the consequences of the July revision of the bar. But there are simply no such figures, since only a few months have passed since the limit was raised. It should take at least six months for some statistics to appear. Without this, it is pointless and premature to talk about the need for another increase in the damage limit under the European protocol," Igor Morzharetto is convinced.

The Euro protocol needs to be rebooted

The proposed amendments do not eliminate the main problem of the European protocol — drivers' distrust of it, says Anton Shaparin, vice-president of the National Automobile Union (NAS). Due to the numerous reservations and nuances associated with self-registration of accidents, motorists are in no hurry to do without police officers.

— Drivers who are involved in even a minor accident are rightly afraid that any mistake or inaccuracy in self-registration of an accident will subsequently lead to the need to beat the thresholds of insurance companies in the hope of receiving at least some compensation. You can remove this limit altogether — drivers will not stop calling traffic inspectors to the scene of accidents, since documents issued by police officers look more reliable in the eyes of motorists than papers drawn up even with the help of emergency commissioners. In order for the Euro protocol to be truly popular, the entire simplified accident registration system requires a complete reboot. With the rejection of additional conditions, "written in small print," the NAS vice president told Izvestia.
