The court allowed cars to be seized from drunk drivers regardless of their income

The Third Court of Cassation of general jurisdiction allowed the seizure of cars from drivers in a state of intoxication, regardless of their financial situation. This was announced on October 16 by RIA Novosti.

The case was considered in relation to the driver, who was twice caught driving under the influence of alcohol. He got off with an administrative penalty the first time, and a criminal case the second time. The court sentenced him to 240 hours of compulsory labor, stripped him of his driver's license for two years and confiscated a Mercedes-Benz CLA 200 car for the benefit of the state. The driver tried to challenge the confiscation in cassation, but to no avail.

"For driving a car by a person who is intoxicated, <...> it is possible to confiscate the car," the court said.

He stressed that the financial situation of the violator does not affect the application of the norm, it is enough to have two conditions: the ownership of the vehicle to the convicted person and its use in committing a crime under Articles 264.1 or 264.3 of the Criminal Code of the Russian Federation.

The application of Article 267.1 of the Criminal Code of the Russian Federation applies to cases of drift, sudden changes of lanes and other dangerous maneuvers, including those recorded on social networks. Violators face fines of up to 300 thousand rubles, restriction of freedom or forced labor for up to two years.
