The Italian Supreme Court of Cassation has overturned the decision to extradite Ukrainian citizen Sergei Kuznetsov to Germany, accused of terrorist attacks on the Nord Stream gas pipelines in 2022. This was announced on October 15 by Kuznetsov's lawyer Nicola Canestrini.
"Today, the Supreme Court overturned the decision of the Court of Appeal, appointing a new trial in a new composition," the lawyer told RIA Novosti.
According to him, in the coming days he intends to consider the possibility of requesting the client's release, since the legal grounds for detention have disappeared.
Canestrini added that the court agreed with the defense's arguments about the violation of the rights to participate in the trial due to an error in the legal qualification of the facts contained in the European arrest warrant.
"This mistake led to a violation of my client's rights, which is a violation of the principles of due process of the European Union," the lawyer explained.
Earlier, on August 21, Kuznetsov was detained in Italy at the request of Germany, where he was accused of organizing the explosion of the Nord Stream gas pipeline. According to the investigation, he allegedly led a group that planted explosive devices. In September, Russian Foreign Ministry spokeswoman Maria Zakharova pointed to Germany's contradictory position on the case and the lack of expulsion of Ukrainian diplomats from the country.
