The law does not prohibit combining self-employment and self-employment, and this is a fairly common practice. Arina Yusupova, deputy head of the legal department of the Console platform for cooperation with the self-employed, told Izvestia on October 13 about how to do this correctly and what restrictions there are.

According to her, first of all, you cannot apply for self-employment to work with the same employer that you are on staff with. For example, an accountant cannot receive a self-employment fee for additional services from the company where he officially works under the Labor Code of the Russian Federation.

"You can't quit and immediately sign a contract as a self—employed person with the same company - the tax service will consider this as avoiding insurance premiums. But at the same time, it is absolutely normal to work in an office, and in the evening to provide private services to other companies (legal entities). In addition, it is important to keep track of income: the limit for the self—employed is 2.4 million rubles per year. At the same time, the salary under the employment contract is not included in this limit," Yusupova said.

In addition, an officially employed employee who combines his main job with self-employment pays professional income tax only on additional earnings. At the main place of work, the employer continues to pay personal income tax and insurance premiums.

Yusupova drew attention to the fact that in order to combine main work and self—employment, it is important to manage resources and time correctly - the main employer should not suffer from the entrepreneurial activity of the employee. Work on personal projects outside of business hours, and do not use corporate resources — neither computers, nor communications, nor the time the company pays for.

"Combining self—employment and hiring is a convenient way to legalize part-time work and not break the law. But we need to make a clear distinction: salary remains salary, and self—employment is about additional income. Then there will be no questions from the Federal Tax Service," the specialist concluded.

He noted that today the employer has to rely not on ready-made specialists, but on the potential of a person: companies raise employees "for themselves", forming individual tracks of professional and personal development. Learning becomes an integral part of the workflow through mentoring and internal self-development programs. Therefore, a graduate with no work experience is an ideal candidate for the company.
