The defense of the veteran, Colonel-General Nikolai Kizyun, who was recognized as a victim in the case of fraud involving a notary, appealed the decision to cancel the initiation of criminal proceedings. Lawyer Alexander Zorin told Izvestia about this on October 7.

In the complaint, the human rights defender noted that Kizyun's consent to his great-grandchildren's living in the apartment does not mean his consent to renounce ownership rights. At the same time, the fact that the text of the document was not read to him and its essence and legal consequences were not explained indicates deception.

Zorin noted that the prosecutor refused to consider key evidence after a visit by Alexander Fedorchenko, a private Moscow notary involved in the case. Thus, the prosecution did not investigate the video provided, and also excluded the explanations that Kizyun gave together with his lawyer. Instead, the veteran's testimony was attached to the case, taken without the presence of a human rights defender, although at that moment the man was not familiar with the details of what had happened.

"We have filed four complaints: two to the courts and two to the higher prosecutor's offices. We hope that the case, which is under the control of the Moscow City Prosecutor's Office, will be transferred to the central office," the lawyer concluded.

Fedorchenko, who was involved in dozens of questionable real estate transactions, could not be held accountable on September 12. Kizyun was tricked into signing a waiver of inheritance. The notary became "famous" after a series of scandals related to equity raiders and a high-profile story about "dead souls" in the signatures of Lyubov Sobol (it was entered by the Ministry of Justice of the Russian Federation in the register of foreign media).

On September 18, the Investigative Committee (IC) recognized Kizyun as a victim in a criminal case of fraud involving a notary. The veteran's lawyer added that Fedorchenko's inaction led to the fact that the veteran's signature was fraudulently obtained and a deed of gift for his housing was issued.
