For using videos with the faces of deceased people created with the help of artificial intelligence (AI), you can receive a serious fine or imprisonment for stalking. Mikhail Salkin, a lawyer in civil and criminal matters, told Izvestia about this on October 7.
"It is difficult to prohibit animation, but using them, that is, publishing them in some way, distributing them, will be prohibited, because the use of images of citizens is protected by the civil code, both in the Russian Federation and similar norms in most of their own countries," the lawyer noted.
According to Salkin, if such actions are repeated systematically, then in foreign legislation it is called stalking, which provides for detention.
At the same time, the expert stated that if a ban is made on the use of photos, videos and voice recordings for neural network processing during life, then this restriction can be terminated after the death of a person, since then the rights of the deceased are enjoyed by his close relatives, as well as heirs.
However, at the moment, the issue is not regulated on a legal basis in Russian legislation. Salkin added that if the video with the deceased contains false information using AI and processing, then an article on defamation may be applied. In addition, within the framework of civil law, compensation can be demanded with the subsequent removal of unreliable material.
Earlier in the day, Zelda Williams, the daughter of actor Robin Williams, expressed dissatisfaction with the appearance of videos with images of her father created using artificial intelligence. She also urged fans not to send such videos anymore, stressing that her father would hardly have been happy with such a thing.
