In Russia, cases of fines for insults have become more frequent. Pavel Voropaev, a member of the Moscow Bar Association, said on Monday, September 22, that when considering cases of this category, it is necessary to understand whether swearing is really offensive and public.

The lawyer noted that not every statement that a person dislikes or offends is an insult. For example, if the statement is a checkmate, then there are quite a lot of chances to win in court.

"However, if there were no explicit swear words in the statement, it is necessary to conduct a forensic linguistic examination. If, according to its results, it is established that a word or phrase in speech form during the conflict is offensive, contains signs of humiliation of honor and human dignity, the court will seek moral compensation from the offender," he said in an interview with Radio 1.

According to Voropayev, the amount of compensation will depend on the form of the insult, as well as on the identity of the person who was insulted.

He added that a public insult to a government official in the performance of his official duties or in connection with their performance should be singled out separately. In this case, criminal liability is also provided in the form of a fine or correctional labor.

Earlier, on September 16, lawyers said that the use of emojis in correspondence with the intention of insulting a person may be recognized by the court as a sign of Article 5.61 of the Administrative Code of the Russian Federation ("Insult").

Mikhail Reprintsev, Managing Partner of the Fair Solutions Law Firm, clarified that the article "Insult" more often considers the use of profanity or other indecent statements against a person with the intention of insulting him.

Earlier, on September 11, the district court in Krasnoyarsk canceled a fine issued by the magistrate's court for insulting in a country chat using the word "habalka" and a clown emoji. Earlier, the prosecutor agreed that the combination was offensive and the applicant perceived it as such.
