Animal inheritance in Russia is rare, mainly due to the lack of a unified registry and difficulties in applying legal mechanisms in the absence of registration of pets. Svetlana Serebryakova, a family lawyer, told about this on September 14.

According to Silver, Russian legislation considers animals as objects of civil rights, that is, as property. This means that the general rules concerning ownership apply to them, since they do not have subjectivity (art. 137 of the Civil Code of the Russian Federation).

"The list of property that cannot be included in the inheritance has been approved, and animals are not included in this list. Thus, the testator can: transfer animals to inheritance by law or will; assign to the heirs the obligation to keep the pets belonging to the testator (testamentary assignment) (art. 1139 of the Civil Code of the Russian Federation); appoint an executor of the will, who will be able, if necessary, not only to fulfill the testamentary assignment, but also to require the heirs to fulfill it (subclause 4 of Clause 1135 of the Civil Code of the Russian Federation)," she explained "Газете.Ru ".

It is important to remember that accounting for animals is mandatory in agriculture: information about both the animals themselves and their owners is entered into special databases, the lawyer notes.

"Thus, the legal framework for animal inheritance exists in Russia, but its practical implementation rests on the problem of accounting. The widespread introduction of mandatory pet registration systems will be a key step towards ensuring that the rights of heirs and the fate of animals are protected by law, rather than being solved by default in a domestic manner," she concluded.

Marianna Onufrienko, Doctor of Veterinary Sciences, expert at the Center for the Study of Nutrition and Animal Welfare, told Izvestia on September 3 that pets teach children to be kinder and more responsible every day. She clarified that by interacting with pets, children can observe the immediate consequences of their actions and learn to recognize emotions, even if they are not expressed in words.
