The lawyer told about the actions when the restaurant included tips in the check
The customer is not obligated to pay tips in a cafe, restaurant or hotel, and if these establishments include tips or service interest in the bill, exposing this as a visitor's responsibility, this is illegal. Vitaly Bogomolov, the lawyer of the Moscow Law Firm Klishin & Partners, told about this on Friday, September 12.
He clarified that consumer service establishments do not have the legal right to include tips or additional services in the bill that have not previously been announced to the consumer.
"If the visitor has not agreed to additional services for an additional fee, then the contractor cannot perform them for money," the lawyer said in an interview with RT.
He stressed that the decision on whether to leave a tip or not is made by the visitor himself, it should not be imposed.
If the bill contains interest for the service or tips are included, the visitor may not pay them or demand a refund if the payment is made, he noted.
"If the administration ignores the request or refuses, you should write a written complaint to the general director of the institution," concluded Bogomolov.
On August 27, it was reported that cafes and restaurants in Krasnodar, Nizhny Novgorod and Vladivostok became the leaders in terms of service quality, according to the Izvestia Waiter Index compiled by experts from the Security 2.0 monitoring center (under the Russian Peace Foundation).
In April, a study by the Smoothly service showed that the majority of respondents (62%) believe that the tip amount should depend on the amount of the check. One third of the respondents leave 5-10% of the order price. At the same time, every fourth respondent is fundamentally opposed to this practice, according to 360.ru .
