Construction or reconstruction of buildings and structures without obtaining a building permit is prohibited. Such real estate objects may be recognized as unauthorized buildings in accordance with the legislation of the Russian Federation. This was stated to Izvestia by the press service of the Ministry of Construction of Russia.
"An unauthorized building created or erected without design documentation, expertise and other permits is subject to demolition due to the fact that it may pose a threat to the life and health of citizens. In the absence of documents, it is impossible to establish the safety of an unauthorized building," the press service of the Ministry of Construction noted.
A decision to bring an unauthorized building into compliance with the necessary requirements cannot be taken if the capital construction object, including an apartment building, is erected on a plot of land, the use of which does not allow the construction of such an object on it. Basically, such land plots are provided for individual housing construction or gardening.
"The legislation establishes cases in which a decision cannot be made to demolish an unauthorized building or bring it into compliance with established requirements," the ministry said.
Local self-government bodies do not have the right to make a decision on demolition if the ownership of an object is registered in the Unified State Register of Real Estate (USRN) or recognized by a court. This rule applies to both apartment buildings and garden houses built before January 1, 2019 on suburban and garden land plots.
Earlier, the head of the region, Sergei Melikov, told TASS that an assessment of illegal multi-storey buildings in Dagestan had been carried out; now, together with law enforcement and supervisory authorities, work is underway to clarify the reasons that led to this problem.
According to him, residents of illegal houses will be resettled only if the buildings are recognized as emergency. According to the latest data from the Makhachkala administration, 900 apartment buildings have been identified in the city, which were built illegally and are classified as problematic.
