The Supreme Court explained the difference between "kickback" and a bribe
The Supreme Court of Russia explained the difference between a bribe and a kickback, explaining that in the first case it is necessary to prove the transfer of money to an official who promised protection. This was announced on August 21 by the Russian Agency for Legal and Judicial Information (RAPSI) on its website.
It is specified that the court considered the case of Bashkir official Dim Muslimov, who was found guilty of abuse of office and taking bribes in 17 episodes. The court then sentenced the man to 13 years in a penal colony with a fine of 60 million rubles and the deprivation of the rank of "colonel of the internal service."
The publication explains that the defendant forced employees to write him reports on payments that he claimed, after which the employees returned to him part of the funds received.
Later, Muslimov's lawyer indicated in the complaint that in this case it was not about bribes, but about kickbacks. Accordingly, the case should be considered under the article on abuse of authority. The Supreme Court agreed with these arguments and stressed that the official had not retaliated in the interests of those who allegedly gave this bribe. In this regard, the court sent the decision for a new appeal to the Court of the Republic.
Earlier in the day, the RF Armed Forces allowed citizens to rent private residential premises on a daily basis. It was clarified that the agency reviewed the case of a resident of the Sheregesh ski resort, who built an apartment building and a complex with a swimming pool, sauna and hammam on the site. The land plot corresponds to the category "tourist services, public use of capital construction facilities, recreation". It later became clear that the house was being rented and used as a hotel.
The state prosecution appealed to the court in defense of a circle of people with a request to prohibit the short-term rental of housing construction. Three courts agreed with the employee of the supervisory authority, but the Supreme Court of the Russian Federation sided with the owner. According to him, the legislation allows for the extraction of income from renting out their own residential premises without a time limit.
