In a number of Russian regions, cases of fictitious marriages are being investigated before military personnel are sent to a special military operation zone (SVO) to receive compensation and benefits. Maria Voropayeva, First deputy head of the LDPR central office and a member of the Moscow City Duma, told Izvestia on August 15 about the legal framework, as well as initiatives and changes aimed at combating this problem.

According to her, the Family Code of the Russian Federation provides an opportunity to recognize fictitious marriages as invalid if they were concluded without the intention of starting a family. The consequences of the invalidity of such marriages are regulated by Chapter 5 of the RF IC.

"Illegally received amounts are subject to refund as unjustified enrichment (art. 1102 of the Civil Code of the Russian Federation). Criminal qualification of actions to seize payments is possible under Articles 159 of the Criminal Code ("Fraud") and Article 159.2 of the Criminal Code ("Fraud in receiving payments")," Voropayeva said, noting that punishments include fines and imprisonment of up to six years, depending on the damage.

In addition, the deputy called the signs of a fictitious marriage. She explained that they include expedited registration before being sent to the CBO zone, the absence of actual relationships, and the involvement of intermediaries. Currently, judicial mechanisms are being developed to establish the fact of cohabitation in order to receive payments, which should reduce the motivation to enter into fictitious marriages.

The expert stressed that the introduction of new norms into legislation could lead to three different scenarios. The first one presupposes the possibility of declaring a marriage invalid in court, provided that it is proved to be fictitious. The second scenario concerns the return of the received amounts, which will be considered as unjustified enrichment. Finally, the third one involves the criminal prosecution of the organizers and beneficiaries of fictitious schemes.

On July 22, the Russian State Duma adopted an amendment on the right of civilian wives of deceased members of the military to benefits provided they live together for three years, as well as have a child together. As part of the initiative, widows of military personnel can be provided with social support measures for running a common household at the time of signing a contract for military service, including for mobilization.
