Discontent is growing in the freight transportation industry due to the amendments to the Code of Administrative Offenses (CAO) that have entered into force, tightening penalties for overloading and oversized cargo. Carriers claim that the new measures endanger their business, and some even plan to withdraw from the market. This was reported by the Delovoy Peterburg newspaper on July 24.
The minimum penalty for exceeding the dimensions of the cargo by 10 cm is 150 thousand rubles. If the cargo exceeds the permissible limits by 20 cm or is overloaded by 10-20%, the fine increases to 300 thousand rubles.
It is noted that if the dimensions are exceeded by 50 cm or overloaded by 20-50%, the amount of the penalty reaches 450 thousand rubles. The maximum fine — 600 thousand rubles — is imposed for an attempt to evade weight and size control, and the owner of the car is obliged to pay it.
Due to stricter controls, truckers are forced to either pay heavy fines or carry less cargo at increased rates. Road and construction companies have already received notifications about the increase in transportation prices. The average rate on the St. Petersburg — Moscow route has increased by 5% since the beginning of July, to 43.8 thousand rubles, and increased by another 6% last week.
Empire LLC stated that the new rules require additional control measures and risk reduction. Nerud-Trade, a company engaged in the trade of construction materials, suspended shipments due to rising transportation prices. Some carriers are planning to leave the market altogether, since even a 6% tariff increase does not cover their costs.
"Yes, there are minor disruptions with the supply of inert materials, but they are not critical and the contractors are solving them," said the director of one of the construction companies.
Sergey Bogatov, a lawyer in the field of automobile cargo transportation, explained that many carriers go to overloading because of the economic benefits, since the standard load is often only half of the body. At the same time, every second fine, according to the carriers, was issued unreasonably. The Accounting Chamber confirmed that about half of the automatic weight and size control points are not working due to equipment breakdowns and pavement defects.
Vladimir Matyagin, President of the National Association of Truck Motor Transport Gruzavtotrans, reported problems with the APVGC in Novaya Ladoga, where incorrect measurements are possible due to rust in the equipment. He stated that one of the carriers received a fine of 20 million rubles, and the other received a notice of overloading from 35 to 53 tons, although the truck left the quarry with a lower weight.
Earlier, on July 10, the State Duma adopted in the first reading a bill to reduce fines for taxis operating without a carrier's compulsory civil liability insurance (OSGOP).
