If the goods were damaged during transportation, the first and most important thing is to fix the condition of the cargo before shipment. On July 9, Ivan Irov, the head of the claims department of the PEC, told Izvestia about this.
"Take detailed photos and videos from all angles, including existing defects. These materials will be the key evidence in case of disputes. This is especially important for remote transactions, when the buyer cannot personally check the goods before shipping," advised Irov.
Upon receipt of the damaged cargo, the expert recommends that you immediately notify the delivery service and jointly draw up a damage report. If a company representative refuses to sign the document, it is necessary to record this fact on video or involve witnesses.
According to the Federal Law "On Freight Forwarding Activities", the recipient has six months to file a claim. However, Irov advises not to delay. According to him, it is better to file a claim within 24-72 hours, attaching an act, photo and video materials, as well as a preliminary repair bill.
Insurance companies usually review documents within five business days. If in doubt, an independent expert examination is appointed. However, without first fixing the condition of the cargo before shipment, it will be extremely difficult to prove the carrier's guilt.
In case of refusal of compensation, you can go to court, but, as noted by Irov, this entails additional costs and may take more than a year.
"It is much more effective to try to negotiate in a pre—trial manner — many carriers are ready for compromise solutions," the expert concluded.
The expert also draws attention to the importance of timely acceptance of the cargo, as a penalty may be charged for delay under the contract.
