He noted that the court of the Southern District of New York, where the Combs case is being heard, is known for decisions on major cases. There, defendants in articles on human trafficking have been sentenced to life in prison more than once, like the rapper, and life sentences have been imposed. However, according to the most serious racketeering article, the judges did not find P. Diddy guilty.
"The jury found him guilty of one article and two counts, so to speak, of the same article. The most difficult articles were removed. Of course, he is very happy, because this article is related to a racket: a group that engaged in human trafficking, so to speak. This is an article that gives a life sentence, and his lawyers managed to remove this article, in general," said Buch.
Another serious article, human trafficking, where the prosecutor's office claimed that Combs allegedly "brought people and he sponsored it," was also removed from the charges. He could have received from 15 years to life in prison.
"The smallest article left is the transportation of people for the purpose of prostitution in two episodes. In reality, the court considers such a case to be quite liberal, and relatively lenient sentences were passed on it. In this case, the judge will decide whether he agrees to run these two 10-year terms in parallel or sequentially. According to the law, since these are two different victims, he has the right to release them sequentially. But usually the judge is quite mild-mannered in this district. Maybe, so to speak, P. Diddy will get off with up to 10 years," the lawyer said.
Thus, the question is being decided whether the musician will be imprisoned for 10 years or less, said Buch. It is important that in the US federal system, deadlines are less determined by articles, and more by the factors that surround this situation.
"In terms of the number of victims, the severity of the crime itself, the level of physical, psychological, and psychiatric injuries to the victims, financial elements also create an additional level and stricter deadlines. But in the case of P. Diddy, the judge is limited to a term of 10 years," explained Buch.
A final decision on such a case can usually be formulated in two to three months. Then the judge will set the date of the verdict and the listeners will learn the fate of the accused and the term assigned to him. According to the lawyer, hardly anyone wants Combs to be released on bail before the verdict is announced. Therefore, he will spend all this time in the cell.
