"It is almost impossible to apply for a loan in someone else's name without the knowledge of a person in a large bank. The situation is much simpler with microfinance organizations. According to the lawyer, if such a situation occurs, you must first contact the organization where your data was used to conclude a loan agreement. The company will conduct an internal investigation and, if fraud is confirmed, will write off the debt. If this does not happen, you need to file an application with the court.
Lapugov clarified that the probability of a court ruling in favor of the plaintiff is quite high. The judicial authority will verify the authenticity of the signature in the contract. It is most difficult to challenge a loan if it was issued online and the Gosuslugi service was used for authorization on the microfinance organization's website. In addition, the victim needs to contact the police, since obtaining a loan in someone else's name is a crime.
"The application must be accompanied by copies of the documents received from the credit institution, as well as a copy of the certificate of loss of the identity card, if any," the lawyer noted.
