Lawyers explained the algorithm of actions when a taxi driver refuses to take a child

If a taxi driver refused to take a family with a child, despite the fact that passengers had their own child safety seat, or demanded an additional fee for transporting a child, he violates current legislation, lawyers told Izvestia.

Discrimination against families with children remains when traveling by taxi, experts from the Popular Front noted after monitoring the implementation of Russian President Vladimir Putin's instructions to support large families. There were cases when drivers refused to accept orders at the children's rate or did not transport passengers with children at the usual rate, despite having their own child safety seat.

Such actions qualify as a violation of consumer rights and transportation rules, the driver is obliged to accept the order if security measures are followed, and an increase in the tariff for having a child or a car seat is not allowed, said lawyer Ekaterina Kutuzova.

If the fare increase is related to the transportation of a child, this must be clearly stated in the terms of service and communicated to the client in advance. Any other fare increase without the passenger's prior consent is a violation, added Zaur Lapugov, a lawyer at Afonin, Bozhor and Partners LLC.

"If a passenger is faced with a similar situation, the first step is to file a complaint with the taxi company's support service with a detailed description of the situation," he recommended.

It is important to record the fact of a refusal or an increase in the tariff, for example, to take a screenshot of the order, record the conversation, added Vladimir Kuznetsov, Vice President of the Association of Lawyers for Registration, Liquidation, Bankruptcy and Judicial Representation.

The lawyers also recommended filing a complaint with Rospotrebnadzor in person or through the official website. An extreme measure may be to apply to the court with a claim for consumer protection, where you can claim damages and compensation for moral damage.
