The main danger when transferring money is accidental involvement in transactions that can be regarded as financing terrorism, extremist activities, or illegal armed groups. To minimize risks, it is necessary to document the origin of the funds and the purpose of the payment, avoiding vague phrases like "for services" or "personal needs." Lawyer Albert Khaleyan told Izvestia about this on June 20.
According to him, special care should be taken when transferring large amounts, especially if they do not match the sender's usual financial profile.
"Regular transfers just below the threshold of mandatory control (600 thousand rubles) or fast chains of transactions between unrelated persons immediately arouse suspicion," the lawyer warned.
Haleyan stressed that even transfers to friends and relatives can attract the attention of regulatory authorities if the recipient appears on sanctions lists or has problems with the law. In such cases, it is critically important to have documentary evidence of the relationship: receipts, contracts, or receipts explaining the purpose of the transfer.
"Transfers that don't fit into your usual financial profile (for example, a pensioner suddenly transfers a million to a friend) also raise questions. "Disrupted" payments may also seem suspicious — the transfer of one large amount in several transfers in a short time," the specialist warned.
At the same time, transfers to "dubious" legal entities, people with whom there is no kinship, especially large amounts, may raise doubts. Transfers via anonymous wallets should also be avoided.
If you have any questions from the bank or law enforcement agencies, the lawyer advises you to immediately provide the requested documents and explanations.
"Ignoring such requests is a sure way to block the account and have more serious consequences," the expert noted.
In difficult situations, it is recommended to immediately contact a lawyer specializing in financial crimes.
In addition, to protect himself, the lawyer recommended keeping checks and statements confirming the source of funds. Specify the specific and true purpose of the payment. Also, in some cases, you may need witnesses who can confirm the fact of a loan, donation, or provision of a service.
"The main risks are not related to everyday transfers to friends for understandable purposes, but to transactions that have signs of financing prohibited acts, cashing out. The main protection is transparency, documentation of transactions and willingness to confirm the legality of the origin of funds and the purpose of the payment," Haleyan concluded.
