To recover damages, it is necessary to draw up a documentary evidence base. For example, the lawyer recommended an independent damage assessment.

"The appraiser must inspect the apartment before the start of the renovation, examine the act on the bay, photo / video. He will make a detailed report calculating the cost of restoration repairs (materials, work) and lost property at market prices on the date of flooding," Ivanova said.

Before going to court, the lawyer advised trying to resolve the conflict peacefully, but if the perpetrator ignores or refuses to take responsibility for what happened, you need to go to court.

"It is necessary to apply to the magistrate's court: if the price of the claim is up to 100 thousand rubles, and to the district (city) court — if the price of the claim is over 100 thousand rubles," the expert shared.

As Ivanova noted, the statement of claim must include all the necessary information related to the case and attach a package of all previously collected documents.
