The lawyer told about the rules for installing fences in suburban areas


In recent months, questions have been increasingly raised in legal practice about whether blind fences between neighboring plots are now prohibited. Judicial lawyer Lyubava Trofimova told Izvestia on June 9 about common misconceptions about installing blind fences.
According to the expert, the law that banned all blind fences in Russia overnight (allegedly from June 8, 2025) was not adopted. The regulation of fencing issues is carried out on several levels, and here lies the main confusion.
"The basic rules are contained in the code of rules of JV 53.13330.2019, which allows only mesh or lattice fences up to 1.5 m high between garden plots. However, if the neighbors give written consent, you can install a fence made of other materials," said Trofimova.
These rules apply exclusively to gardening co-ops and do not apply to plots for individual housing construction (IHS), unless local authorities have established their own standards. Also, the restrictions do not apply to the external borders of horticulture and land used for business activities.
The lawyer noted that in some regions municipalities impose additional requirements on fences, for example, limit their height or the degree of transparency from the streets. You can check the rules in force in a particular locality on the website of the local administration.
If the owner receives requests to demolish the fence, the specialist advises to first check the category of the site according to the Unified State Register of Legal Entities and study local regulations. In case of conflict with neighbors, it is worth trying to get their written consent to the existing fence. When an agreement does not work out, it remains to go to court.
"The demands of the authorities must have a clear legal basis. If the norms are adopted with violations, they can be challenged in court," said Trofimova.
As for possible legislative changes, we should expect further unification of requirements for fencing of land plots. The Ministry of Construction and Housing and Communal Services of the Russian Federation is working on issues of improving urban planning legislation, which may also affect the rules on fences.
Thus, the ban on blind fences is not absolute and largely depends on the status of the land plot and local regulations. It is important for owners to carefully study the current rules and, if necessary, defend their rights through the courts.
On April 10, lawyer Ilya Rusyaev reminded that the main fines for summer residents are related to non-compliance with sanitary and fire protection requirements, violations in the use of land, as well as issues of registration of buildings. According to the expert, the most common reason for a fine remains cases when summer residents arrange bonfires or roast meat in mangalas, without observing a distance of 5 m from buildings.
