The Supreme Court recalled the right to leave the scene of an accident to prevent congestion

The Supreme Court of the Russian Federation ruled that the driver involved in an accident has the right to temporarily leave the accident site if necessary to ensure passage to other vehicles and prevent congestion. The relevant decision was made on May 29 following a review of the administrative offense case.

"The Supreme Court decided to partially satisfy the complaint. The decision of the justice of the Peace of the judicial district No. 214 of the Lomonosovsky district of Moscow dated June 3, 2024, the decision of the judge of the Gagarinsky District Court of Moscow dated August 29, 2024, and the decision of the judge of the Second Court of Cassation of General Jurisdiction dated December 26, 2024, issued in relation to the case of an administrative offense under Part 2 of Article 12.27 of the Administrative Code of the Russian Federation <...>, to change, to reclassify actions to Part 1 of the same article <...> with the imposition of a fine in the amount of 1 thousand rubles," follows from the materials at the disposal of TASS.

It is noted that earlier the justice of the peace, as well as the courts of higher instances, found the woman guilty of leaving the scene of the accident. The reason for the revocation of a driver's license was the argument that after an accident on Leninsky Prospekt, the driver drove off to a stand-in in order not to interfere with traffic.

The Supreme Court, in turn, did not agree with the relevant conclusions and stressed that moving the vehicle is allowed provided that the circumstances of the accident are recorded in advance.

The Moscow region Ministry of Transport announced on May 22 that the Moscow region has begun to massively implement the function of recognizing the use of a phone while driving in photo-video systems. Marat Sibatulin, Minister of Transport and Road Infrastructure of the Moscow Region, stressed that currently 30 complexes are registering this type of violation. According to him, 105 cases of drivers using mobile devices have already been identified.
