The new government bill, which provides for taking into account the employee's performance when calculating bonuses, will protect employees from unfair actions by the employer. HR specialist Zulia Loikova told Izvestia about this on May 27.
According to the document, the employer is now required to specify in detail in the employment contracts of regulatory local acts all types, sizes and terms, as well as the conditions of all incentive payments that will make it possible to protect employees.
In particular, the bill allows bonuses to be reduced due to disciplinary penalties, but this applies only to those awards that were accrued over the period of misconduct and no more than 20% of salary.
"This is a good opportunity to additionally protect the rights of our employees from unjustified wage cuts, because, unfortunately, unscrupulous employers have begun to do this," Loikova stressed.
She clarified that some companies prescribe part of the salary as bonuses to solve their tasks.
"In terms of companies, bonuses are conditionally the same salaries, divided into some parts. That is, in fact, a person is not being paid extra for his salary, without any justification. From the last one, I heard that [the employees] performed the task poorly, there were fewer sales, the market just sank, for example, in this segment, but the employee himself performed the work efficiently," concluded Loikova.
On May 27, the State Duma adopted in the second and third readings a government bill providing for adjustments to the Labor Code of the Russian Federation regarding the procedure for taking into account employee performance when calculating bonuses. According to the amendments, employers will be able to take into account disciplinary penalties when calculating bonus payments.
