They want to add information about violators to the register of illegal employment. As Izvestia found out, such a bill will be submitted to the State Duma on May 28 by deputies of the LDPR faction led by Leonid Slutsky.
In an explanatory note to the document, which is available to Izvestia, it is reported that from January 1, 2025, the Federal Service for Labor and Employment (Rostrud) maintains a publicly available register of employers who have revealed facts of illegal employment (part 4 of Article 5.27 of the Administrative Code of Russia — evading the registration of an employment contract or the conclusion of a civil contract, actually regulating the labor relations between the employee and the employer).
"The specified register reduces the risks of violation of labor rights, allowing citizens looking for work to obtain reliable information about employers before employment. At the same time, employers who violate labor laws under articles of the Administrative Code 18.15 remain outside the scope of public accounting," Izvestia said in an explanatory note.
According to him, in this regard, the draft law also proposes to include information on employers brought to administrative responsibility for violating Articles 18.15 and 18.16 of the Administrative Code of the Russian Federation in the register. For a period of one year in the register of employers who have committed these violations, prohibit them from participating in the procurement of goods, works, and services to meet state and municipal needs.
The document emphasizes that this gap allows unscrupulous employers to legally participate in state and municipal procurement, which contradicts the principles of competition, openness and transparency in the field of procurement.
"Unscrupulous employers have significant competitive advantages by illegally hiring foreigners and stateless persons. Of course, if you do not legalize labor relations with migrant workers who agree to everything, do not pay taxes and contributions for them, and ignore social guarantees, it is always easier for such "tricksters" to bypass law—abiding companies at various public procurement contests and tenders," Leonid Slutsky explained to Izvestia.
Last year, on July 24, Rostrud issued an explanation, according to which it is illegal to require an employee to come to work 10 minutes before it and stay the same amount of time. If a specialist is delayed on his own initiative, then this is not considered overtime work, and processing is not paid, the experts explained.
