The Supreme Court recalled the ban on the arrest of pregnant women for minor crimes

The Supreme Court of Russia recalled the refusal to arrest and send pregnant women and single parents to jail if they are accused of minor and moderate crimes, as stipulated in the Code of Criminal Procedure (CPC). The relevant remark is contained in the draft resolution of the plenum of the court, available to Izvestia.

"A minor, a pregnant woman, a woman with a young child, a man who is the only parent of a young child, the adoptive parent or guardian of a young child, the only parent, adoptive parent, guardian or trustee of a disabled child, suspected or accused of committing a crime of minor or moderate severity, the preventive measure in the form of detention is generally chosen it cannot," the document says.

It is noted that, in accordance with sub–paragraphs "a" - "d" of paragraph 1 of Part 1 of Article 108 of the Criminal Procedure Code of the Russian Federation, arrest may be chosen as a preventive measure if persons falling into this category are accused or suspected of a crime of moderate severity involving violence.

"At the same time, the court should take into account the provisions of Part 6 of Article 88 of the Criminal Code of the Russian Federation, according to which detention as a preventive measure cannot be applied to a minor under the age of 16 who is suspected or accused of committing a minor or moderate crime for the first time, as well as to other minors suspected or accused of committing a minor crime for the first time," the draft resolution explains.

Earlier, in April, it was reported that the State Duma proposed to provide suspects or accused women whose children have not reached the age of four with the opportunity to travel outside the place of detention every two months to visit the child for up to three days. Men will also be able to use the right to a date outside the pre-trial detention center if they are the only parents. Izvestia clarified that the bill is aimed at being recalled to the government by deputies of the LDPR faction led by Leonid Slutsky.
