The Ministry of Construction will tighten the conditions for accepting new apartments

Specialists who carry out construction and technical expertise when accepting apartments in new buildings must have specialized education, the Ministry of Construction is convinced. This was stated by Oleg Speransky, Director of the Legal Department of the Ministry of Construction, during the St. Petersburg International Legal Forum.

The official did not specify at what stage this idea is being worked out and what law is being amended. The ministry did not provide "Izvestia" with additional comments.

The purpose of this transformation, according to Oleg Speransky, is to protect businesses from so-called "consumer extremism", when organized groups of lawyers sue companies (by proxy of buyers) in order to make a profit rather than to protect their violated rights.

Now apartment receivers are not supposed to have any documents to present to developers before appraising an apartment. According to Oleg Speransky, in practice, such pseudo-lawyers file lawsuits in court, manipulating the conclusions of specialist receivers.

How it works in practice: the receivers evaluate a new apartment, fix remarks to it, then they pass them to the developer, who eliminates the defects found. After that, people sign the final act on the apartment, in which the parties agree: there are no more claims to the housing. Then the buyers move into the apartment, live in it and at the same time file a lawsuit in court for poorly rendered services in the course of correcting the remarks, disputing the acceptance certificate for the apartment, which they signed.

People refer to the fact that they could not professionally assess how exactly the developer corrected the remarks after they were eliminated. The courts take the side of the weaker party, i.e. the buyer, and appoint an expert examination, during which the experts can identify minor deficiencies on the part of the developer.

Ultimately, this becomes the basis for the developer to pay material compensation to the consumer.
