Service providers can also turn off light, gas or hot water to the owner as a measure to combat defaulters, but they have the right to do this only after sending an official claim to the debtor.
"However, they have no right to suspend the supply of heating or cold water, as well as to block the sewerage system, as this poses a threat to human health and life," Roskachestvo stressed.
The organization also talked about ways to write off debts for housing and communal services. If the management company has not filed a lawsuit on time, and debts have accumulated, for example, over four years, then you can skip the statute of limitations. In this case, all debts over three years old will be written off if you send a petition to the court to skip the limitation period.
"If the court decides to collect the debt, and the defaulter has neither income nor property, then nothing will be recovered. In this case, the case is closed due to the inability to foreclose," the press service said.
In addition, if the debtor has not paid for housing and communal services in an apartment received for social rent, and he has nothing to pay, then responsibility for the debt is shifted to the owner of the housing, that is, the municipality.
In case of bankruptcy, the debt will be written off, including for housing and communal services, but only the debt that existed at the time of filing for bankruptcy.
At the same time, Roskachestvo recalled that if a debt has accumulated for two or more months for housing and communal services (housing and communal services), then penalties are charged on it.
