What are the restrictions for non-payers?
Several new restrictions may appear for malicious alimony defaulters. Currently, amendments to laws are being discussed that will prohibit debtors from entering the civil service, buying air and railway tickets of increased comfort, and access to "Public Services" will be denied to them. This was announced by the first Deputy Minister of Justice of Russia Evgeny Zabarchuk, speaking at the SPIEF.
— Today we have accumulated a certain pool of proposals that will allow us to move forward (on the development of measures to influence unscrupulous child support workers. — "Izvestia"), — he said. — We will actively work out a ban on such persons from state registration of legal entities and individual entrepreneurs, a ban on the acquisition of real estate and vehicles, a ban on the registration of real estate on state cadastral registration and registration of rights.
It is also proposed to limit alimony payers in the ability to take out loans and loans, with the exception of targeted loans that will be used to repay debts. In addition, the Ministry of Justice is considering the possibility of banning malicious defaulters from opening bank accounts.
In 2024, the total amount of alimony recovered amounted to 92 billion rubles, Dmitry Aristov, director of the Federal Bailiff Service (FSSP), said during the session. He also proposed several restrictions for non-payers. In particular, it prohibits debtors with driver's licenses from using car-sharing services, obtaining a license for weapons, as well as monitoring their expenses.
— It is extremely important to form an intolerant attitude in society towards avoiding alimony payments, — said the head of the FSSP. — This is an effective mechanism both for tracking down malicious defaulters and for motivating the debtor to voluntarily, independently fulfill their obligations.
Starting from May 25, 2025, the register of alimony debtors will start operating in Russia — about 190 thousand people will be included in it, Dmitry Aristov, director of the Federal Bailiff Service (FSSP), reminded Izvestia.
"The register will include three categories of debtors on alimony obligations: those who have been brought to administrative and criminal responsibility, as well as those who are wanted and have not repaid their debts," he said. — The register of debtors is an open resource, it will be an integral part of the database and will be posted on the official website of the FSSP. The issue of posting photos of wanted debtors in the alimony register is being worked out.
Debtors, according to him, will remain on the register until the debt is fully repaid or until the termination of enforcement proceedings. After the blacklist is launched, it is planned to continue its development.
— It is possible to work out the following areas: restriction of persons to receive individual documents, certificates that do not affect vital needs, — Dmitry Aristov explained. — A ban on the use of financial investment instruments, on the sale of tourist vouchers and other measures.
In the three months of 2025, 19.9 billion rubles of alimony have already been collected.
Will bans help reduce debts
In most cases, men do not want to pay alimony for their child, often because of resentment, psychologist Natalia Naumova explained to Izvestia.
"Someone gets the feeling that he's giving money to a woman, not a child," she said. — We often notice in therapy that people have this attitude. Parents are very often offended by each other. And in this situation, an adult turns out to be so infantile and immature that he does not understand what he is taking away from his child.
Because of negative emotions, according to her, an adult tries to imagine "that nothing happened, and allegedly forgets to pay alimony."
"But no matter what kind of relationship the parents have, the child needs to be taken care of," Natalia Naumova emphasized. — And this is what most often the parent who is tied up to pay alimony does not realize, because the child does not live with him.
A ban on large purchases and restrictions on access to important services can significantly affect violators, says lawyer and human rights activist Ekaterina Kutuzova.
"On the one hand, such measures can indeed become an additional incentive for debtors to repay their debts on time," she noted. — On the other hand, it is important to take into account that the measures do not affect conscientious citizens who find themselves in a difficult life situation.
Therefore, the open register of alimony debtors is an urgent and overdue measure of influence, said Mikhail Lisin, a family lawyer.
"There will be an army of thousands of child support debtors in Russia, and this issue needs to be addressed comprehensively and more clearly, starting from improving the bailiff service, sending child support debtors to employment, and ending with expanding the list of restrictions related to being on the register of child support debtors," the expert added.
According to the lawyer, absolutely everyone who has debts should be included in the register, and the consequences should be not only moral, but also more applied. For example, it is necessary to withdraw ownership rights from able-bodied debtors on account of alimony debt, even for the only housing or a share in real estate in favor of their children.
The introduction of bans for debtors will also have a positive impact on demographics, says Maria Todorova, a family psychologist and psychotherapist. According to her, when the state demonstrates real protection of the interests of the child and effective recovery of alimony, women's social confidence increases, especially single mothers. This can reduce the fear of being left without support and become a factor contributing to the decision to have a child.
"The idea of depriving debtors of the opportunity to manage their incomes before paying alimony and introducing control over their expenses looks controversial, but potentially effective," she said. — From a legal point of view, this requires careful consideration, but if legal procedures are followed, such a measure can become an effective tool.
Nevertheless, the proposed restrictions need to be supplemented. For the stability of the system, it is necessary to establish automatic interaction between the FSSP, banks, tax authorities and employers.
— It is desirable to create a digital platform through which you can track the status of payments, see debts and receive notifications, — the expert believes. — There may be "kindly" incentive measures, maybe, for example, in the form of tax breaks for bona fide taxpayers and employers who help in fulfilling alimony obligations.
According to Natalia Naumova, for a more balanced fight against debt, it is also worthwhile to develop methods of pre-trial conflict resolution, strengthen financial education and take into account the individual circumstances of each case, experts said.
