The Ministry of Justice proposed to make the protection of morality the basis for the termination of cases

The protection of moral values could be the basis for the termination of the criminal case. This was stated on May 21 by the head of the Ministry of Justice of the Russian Federation Konstantin Chuichenko at the St. Petersburg Legal Forum.

"I have a suggestion to think about how we can introduce a third ground for exemption from criminal liability in order to ensure that the verdict is fair. Today, we are exempt [from criminal liability] if a person acted in a state of extreme necessity or in a state of necessary defense, and if he defended moral values," he said during one of the forum sessions, which was broadcast on the event's website.

In particular, the Minister drew attention to the situation in the Kursk region during the armed invasion of the Ukrainian army. When the nationalists entered the region, many residents defended their loved ones and property and committed murder as a result. As Chuychenko noted, no one doubts the legality of such actions.

However, if similar situations occur in everyday life, then people have a contradiction between the norms of law and morality. For example, a man who stopped the commission of violent acts against his young daughter and killed a criminal is sentenced to eight years in prison.

"Morality must be embodied in law, and law must be deeply moral. Today, our criminal and criminal procedure codes interpret the concept of justice as the proportionality of punishment to the committed act," he said.

Earlier, on May 19, the Ministry of Justice proposed to tighten criminal liability for desecration of military graves, memorial structures and facilities. It is specified that since February 2022, over 370 facts of desecration of military graves and other objects erected in memory of those who died defending the Fatherland have been recorded in Russia.
