The expert named ways to get paid sick leave for dismissed employees
Employees who quit their jobs retain the right to paid sick leave for one month after termination of employment. Olga Chirikova, senior lecturer at the Department of Civil Law Disciplines at Plekhanov Russian University of Economics, told Izvestia about this on May 12.
According to her, according to current legislation, a former employee can apply for a disability certificate if the illness occurred within 30 calendar days after dismissal. The key condition is that at the time of the illness, the person should not be officially employed in a new organization.
To receive payments, you must contact a polyclinic to receive a sick leave in a standard manner. The document will be handed over to the accounting department of the former employer, who is obliged to pay the allowance for the first three days of illness. The remaining period of disability is covered by the Social Fund.
"The amount of the allowance is 60% of the average earnings for the previous two years. At the same time, insurance experience and other characteristics do not affect the percentage of payment in this case — the rate is fixed," explained Chirikova.
The expert clarified that this provision of legislation is aimed at providing social guarantees for citizens who find themselves in a difficult situation after losing their jobs. This allows you to receive financial support during the period of temporary disability while a person is looking for a new job.
It is important to note that the right to pay for sick leave remains only if all the conditions are met: timely medical treatment, registration of a disability certificate and the transfer of the document to the former employer on time.
Earlier, on January 10, it was reported that the maximum amount of payment for hospital benefits in 2025 is 172,488.69 rubles per month. The largest daily payout will be 5673.97 rubles.
