The lawyer urged to compensate the victims of fraud

The bank or the telecom operator must compensate the financial damage to the victims of fraud, depending on whose fault the crime occurred. Lawyer Dmitry Kvasha told Izvestia about this on May 12.

Earlier in the day, it was reported that banks want to share responsibility with telecom operators for embezzlement of money by scammers.

"If the bank has not fulfilled its regulatory requirements, then it [must compensate for the damage], if the operator has not properly implemented security measures, then, accordingly, <...> it is probably possible to apply some measure," he said.

The lawyer noted that the areas of responsibility of credit institutions and telecom operators in case of fraudulent actions can be prescribed by law.

Banks, he said, should be careful when issuing loans and monitor transfers and amounts, given that victims of scams often voluntarily send money to intruders. Cellular operators, in turn, should check who the mobile numbers are registered to, whether they are on blacklists.

"The main thing is that the person himself, who is a victim of fraud, does not suffer, because while the proceedings between the operator and the bank are going on, the person who took out the loan continues to pay interest," Kvasha emphasized.

He added that credit institutions and telecom operators need joint integration to process information about scammers faster.

"We also have the opportunity to complain that I received calls like spam mailers or scammers. And a note can be made about this, <...> so that the mobile operator informs the bank online that such phone numbers have been compromised," the expert concluded.

Earlier, on April 8, Konstantin Larin, head of the Cyber Intelligence department at Bastion, told Izvestia that the number of fraud schemes in Russia could decrease. According to him, this may be affected by the new law on combating telephone fraud. Thus, the ban on remote creation of SIM cards will make it more difficult for attackers to access banking applications, and limiting mass calls at the initial stage will reduce the number of potential victims.
