The expert appreciated the importance of the Supreme Court's decision on loans taken by fraudsters

The decision of the Supreme Court of the Russian Federation to invalidate loans taken by fraudsters on behalf of the victim through a banking application is important for judicial practice and will allow citizens to more effectively defend their rights. This was stated on April 27 by financial adviser Alexey Rodin in an interview with Izvestia.

"There is no case law in Russia. <...> Our courts should not make exactly the same decision as the Supreme Court did. But, in our practice, the courts take into account [the verdicts of the Supreme Court]. And this is the decision of the Supreme Court, it <... It is very important," he said.

According to the expert, in the past, judicial authorities often sided with banks and forced the victim himself to be responsible for loans taken by fraudsters. Now, the precedent created by the Supreme Court will help people to seek a decision in their favor.

On April 25, the Supreme Court, as part of a review of judicial practice, invalidated loan agreements concluded fraudulently on behalf of a client using the bank's mobile application. The verdict was issued following a criminal case in which fraudsters remotely took out a loan in the name of the victim in the amount of over 265,000 rubles. The court of first instance, as well as the appellate and cassation instances to which the victim appealed, called her actions imprudent, and only the Supreme Court of the Russian Federation sided with the bank's client.
