The Supreme Court allowed knives for self-defense and protection of children against a group of people

Russians can use knives for self-defense, provided there are many attackers and children are in danger. This is stated in a review of judicial practice published on the website of the Supreme Court of the Russian Federation.

It is specified that such an explanation was caused by the case of a resident of Tver. He was on a family holiday when one of his guests had a conflict with a neighbor who called her son and asked him to come and deal with the offender. He arrived drunk with two friends, together they entered the territory of the house and began to beat the alleged abuser and the owner of the house, in whose arms his daughter was. After that, the organizer of the celebration took a knife and stabbed the attackers, as a result of which all three died.

The investigation charged the man under Part 2 of Article 105 of the Criminal Code of the Russian Federation ("Murder"), but the Tver Regional Court, to which the victims appealed, issued an acquittal, citing the fact that what was done was self-defense.

The injured party did not stop there and reached the Supreme Court, where the charges were also challenged, after which the case was included in the review of practice so that other judicial institutions could use it as an example to make the right decisions.

"The court came to a reasonable conclusion that the number of attackers, their aggressive behavior, the circumstances and nature of the physical violence used in the presence of young children against the acquitted person himself, other persons who were in his household, in the evening, as well as the suddenness of the attack and the use of objects used as weapons by the attackers, gave the acquitted person the right to take adequate measures to protect oneself, one's family, including a minor child and others," the review says.

On February 17, State Duma deputy Yaroslav Nilov from the Liberal Democratic Party announced that a bill allowing residents of houses and apartments to use any methods of self-defense when entering their property without the risk of incurring criminal liability would be submitted to the State Duma.
