Svetlana Dobrovolskaya, Chairman of the Moscow Regional Bar Association, Yurlova, Candidate of Law, Honorary Lawyer of Russia, commented on the initiative to coordinate the rental of an apartment with neighbors.

In an interview with Radio 1 on Thursday, April 24, the expert stressed that the bill in question was somewhat inconsistent with current Russian legislation.

"The Civil Code and the Constitution of the Russian Federation contain the exclusive right of ownership of people to the property that belongs to them. This means that a person has the right to own, use and dispose of property belonging to him by right of ownership in full without any restrictions," Dobrovolskaya recalled.

In her opinion, this practice will only provoke scandals between tenants. In practice, it is quite difficult to prove the fact of renting an apartment without a contract. So far, according to her, the mechanism and legal justification are unclear.

The lawyer suggested that such a bill would be ambiguously evaluated by the legislators themselves, because the current rules would have to be changed.

Earlier that day, it became known that State Duma deputies would submit a bill to the House of Parliament, which proposes to oblige apartment owners to coordinate the rental of premises in writing with their neighbors. According to the document, for the absence of a contract when renting out an apartment or a private house, they offered to fine 5-10 thousand rubles, notes 360.ru . For officials, this amount will amount to 10-20 thousand rubles, and for legal entities — 20-50 thousand rubles. It is proposed to apply similar fines for the absence of written consent from neighbors, the NSN notes.

The main essence of the changes, as emphasized by Vladimir Koshelev, deputy chairman of the State Duma Committee on Construction and Housing and Communal Services, is to encourage apartment owners to sign lease agreements in accordance with the procedure established by law, RT reports.
