Marketplaces complained about possible inadequate fines worth billions of rubles

Fines for the largest Russian marketplaces may amount to tens or even hundreds of billions of roubles if the proposed amendments to the draft law "On the Platform Economy" and the accompanying changes to the Administrative Offenses Code are adopted. E-commerce market participants have warned the Ministry of Economic Development about this - such a forecast is given in the materials with the proposed amendments to the legislation.

"Millions of orders are made on marketplaces per day, millions of new product cards are created on storefronts. Under the bill, online platforms will inevitably incur extremely significant costs: according to various estimates, from 41 to 278 billion rubles annually for the two largest marketplaces," the document says.

The press service of Wildberries&Russ told Izvestia that in the current version of the bill the objective side of administrative offenses is not sufficiently defined. The bill proposes to establish administrative liability for violation of any provision of the law "On Platform Economy". This means that liability is not differentiated depending on the severity of the violation and its consequences, the company noted.

If the law "On Platform Economy" and its amendments to the CAO are adopted in the current form, marketplaces will have to refuse to cooperate with small sellers and all those who at least potentially may not fulfill the new requirements, said Karen Kazarian, director of the Institute for Internet Research. This means that the range of marketplaces may decrease, he believes.

In addition, marketplaces are likely to shift the costs associated with fines to sellers - for example, to put them in the tariffs, sellers on buyers, which in a chain will lead to higher prices, he notes.
