The Supreme Court of Russia has recognized the right of citizens to receive compensation for moral harm caused by spam calls with advertisements.
The court examined the case of a Moscow resident who received calls from a bank offering to apply for a loan. The man was not a client of this financial institution, so he sent her a complaint asking her to stop calling, but the spam did not end.
After that, the man went to court demanding monetary compensation of 5,000 rubles for constant inconvenience. The bank, in turn, explained that the calls were made by mistake, and the Muscovite's number accidentally got into the database, which contains the phone numbers of people who agreed to receive the newsletter.
By the decision of the Supreme Court of the Russian Federation, the case was sent for review. It clarifies that the bank's guilt is assumed until proven otherwise.
"The distribution of advertising over telecommunication networks, including through the use of telephone, fax, mobile radiotelephony, is allowed only with the prior consent of the subscriber or addressee to receive advertising. The advertiser is obliged to immediately stop distributing advertisements to the person who contacted him with such a request," RIA Novosti quotes the text of the document.
On February 15, the Russian government submitted to the State Duma a bill to protect Russians from telephone and Internet scams. The draft provides for the introduction of mandatory labeling of calls so that people know who is trying to contact them. In this case, an unmarked call is highly likely to indicate fraud. Russians will also be able to opt out of promotional calls and spam mailings and ban incoming international calls.
