The Supreme Court of the Russian Federation has defended the right of drivers to avoid the scene of an accident. The ruling on the results of the review of the relevant case states that if it is impossible to occupy the necessary lane before turning for objective reasons, then the maneuver is not a traffic violation, the Russian Agency for Legal and Judicial Information (RAPSI) reported on April 10.
The Armed Forces of the Russian Federation examined the case file in which the driver of the car drove around the accident site, which is why he could not take the necessary lane to turn right. During the maneuver, he collided with an electric scooter that was moving along the roadway.
The courts initially found that the driver of the car violated traffic regulations because he did not occupy the position prescribed by the rules during the turn. As a result, he was deprived of his rights for 1.5 years. At the same time, the scooter rider admitted that he was moving along the lane for the movement of fixed-route vehicles, because "there was a wavy surface on the sidewalk and it was shaking."
The higher court concluded that the driver had occupied the only rightmost position available to him in the circumstances, therefore, he had not violated traffic regulations. The Supreme Court of the Russian Federation recalled that drivers who violate traffic regulations on the correct trajectory do not have a preferential right of movement. Scooters are equated to pedestrians: in the absence of a special road, they are required to drive along the sidewalk, shoulder, or move in a row along the edge of the roadway towards the movement of vehicles, the Supreme Court noted.
On January 9, RAPSI reported that, as the Supreme Court of the Russian Federation ruled, a driver involved in an accident has no right to drink alcoholic beverages, even if other car owners have no complaints against him, and he is the only participant in the incident.
On December 6 last year, it was reported that, as recognized by the Russian Armed Forces, a driver who is drunk has no right to drive, even if he is asked to do so by a traffic police officer. The highest court reviewed the case of the driver, who was deprived of his license for drunk driving. He insisted that he was not going to get behind the wheel, but was forced to do so on the instructions of the traffic inspector.
