Roskachestvo warned about fines for tenants for lack of registration


If the owner of an apartment rents it to tenants and enters into a contract with them for a period longer than 90 days, he is obliged, if necessary, to make them temporary registration in this apartment, Igor Pozdnyakov, director of the Consumer Protection Department of Roskachestvo, told Izvestia on April 10.
"Otherwise, he may receive a fine, just like a person who lives without registration. The fine is 5-7 thousand rubles for Moscow and St. Petersburg and 2-5 thousand rubles for other regions of Russia (art. 19.15.1 of the Administrative Code of the Russian Federation). If the apartment owner does not sign a contract with the tenants (tenants) and does not make a temporary registration at their request, this violates the law! It is better not to take risks, as the contract is insurance for both sides of the transaction," he explained.
According to him, the validity period of the temporary registration is stipulated in the documents. If the tenants leave the apartment ahead of time, you can cancel the registration ahead of time. At the end of the validity period of the temporary registration, it is automatically cancelled.
Pozdnyakov recalled that temporary registration is necessary if a person leaves the place of residence where he has a permanent residence permit and lives in another place for more than 90 days.
"Very often, owners fear that temporary registration will give tenants some rights to real estate. Yes, tenants have certain rights to use the apartment, but they will not be able to "take" it into ownership in any case. If registration is only temporary, you definitely don't need to register outsiders in your living space — this is very important," the expert added.
Ownership rights, the ability to dispose of an apartment, rent it out, sell it, repair it, and so on remain with the owner.
At the same time, residents have the opportunity to use the apartment for the duration of the contract and temporary registration. This means that they can live in it, come at any time, use everything in the apartment, bring guests — do everything that is not prohibited by law or separately by the lease agreement.
"Residents can register minor children in the apartment. And without the consent or even notification of the owner. It is assumed that temporary registration means that the owner agrees that the children will also be registered, because they must live with their parents and be registered at the registration address of one of the parents (or both). But this does not mean that the child will now have the right to this apartment," Pozdnyakov drew attention.
As soon as the period of validity of the temporary registration of parents expires, the registration of the child in the apartment will also cease. But if the owner has registered tenants on a permanent basis, then problems may arise, because in the absence of the parents' desire, the child can only be discharged through the court. Therefore, there is no need to register permanently for strangers.
Other consequences of temporary registration of tenants include an increase in utility bills if no metering devices are installed in the apartment. There are also possible visits by bailiffs or the police if the tenant turns out to be in debt or violates the law. In addition, there may be difficulties with evicting tenants before the expiration of the temporary registration period.
