How to arrange a common water well in a horticultural association

It is allowed to use the natural resources of the earth only if there is a special permit — license. This rule also applies to water wells for horticultural non-profit partnerships. Izvestia tells us how to arrange a common water well in the country and what is the penalty for its illegal installation in 2025.
What is a water well?
A common well is one of the most common methods of water supply in dachas. It allows all members of the farming community to receive water for irrigation, drinking and other household needs. All members of the gardening association can use water from the well.
At the same time, the extraction of groundwater for general use is regulated by law. In the case of a collective water supply, responsibility for the illegal use of the well is distributed collectively to all land owners. An exception is made for private wells.
In this case, permission is not required if a number of conditions are met. First, water should be used only for its own needs. The second condition is that daily water consumption should not exceed 100 cubic meters per day. And the depth of the well cannot be more than five meters or must reach the groundwater level.
How can a farming co. register a water well
If earlier, in order to formalize a common water well, it was necessary to conduct geological exploration of the area, order an expert draft of a water intake and coordinate it with the supervisory authorities, then after amendments to the federal law "On Subsoil", such actions were no longer necessary.
Currently, a simplified procedure for obtaining a license is in effect. Starting from January 2020, all farming co-ops must have it. You can apply for a document at any branch of the MFC or through the Gosuslugi portal. But first you will need to collect a whole package of documents.
First of all, these are the statutory documents of the partnership, documents confirming the powers of the chairman, the calculation of water consumption, the layout of the well and, most importantly, the passport of the well.
When a partnership is just planning to drill a well, it is necessary to attach a letter to the main documents with an obligation to conclude a contract for drilling it and passports of existing wells. And if several wells are connected to each other, then there is also a plan for water supply networks.
A state fee of 7.5 thousand rubles is provided for the registration of the license. It must be paid before submitting the application from the settlement account of the horticultural association. The permit is issued within 60 working days.
How long is a water well license issued?
The license is granted for a period of up to 25 years. After this period, the document must be extended or the well must be preserved or liquidated. You can find out the validity period of the permit in the license register on the Rosgeolfond website.

What is the penalty for illegally installing a water well?
Specialists from the Department of Environmental Management regularly check for licenses, as well as monitor water quality. Supervisory measures are applied both to organizations, individual entrepreneurs, and horticultural associations. Violators may face a fine of up to one million rubles (art. 7.3, Part 1 of the Administrative Code of the Russian Federation).
The agency recommends that all owners of garden plots make sure that the farming co-op has a license to use the well. This is also necessary in order to be sure that the water is clean and free of impurities. It is best to do this before the start of the summer season.
Earlier, Izvestia reported that the State Duma would impose fines for unauthorized use of water supply and sanitation systems.
