Alexander Khaminsky, a lawyer and head of the law enforcement center in Moscow and the Moscow Region, said that People's Artist of Russia Larisa Dolina did not leave the apartment, which became the subject of a legal dispute.
In conversation with aif.ru On Monday, March 29, he stressed that the singer had actually been living in it all this time, despite the fact that she had formally sold the property.
"Polina Lurie, who bought the apartment, filed a counterclaim demanding that Dolina and her relatives be evicted and removed from the register. However, the court denied this requirement," the lawyer explained.
The court's decision has not yet entered into force, as an appeal may be filed. If the Court of Appeal upholds the verdict of the Khamovnichesky Court of Moscow, Lurie's right to an apartment will be permanently revoked.
Dolina, according to the lawyer, it is necessary to obtain a writ of execution, apply with it to the registration authority, after which the entry on Polina Lurie's ownership will be canceled in the state register of real estate rights.
On March 28, the Khamovnicheskiy District Court of Moscow ruled in favor of Larisa Dolina on the counterclaims of the singer and the buyer of her apartment, Polina Lurie.
On January 17, the court recovered more than 69 million rubles in favor of singer Larisa Dolina in the criminal case of fraud against her apartment. The money will be returned to the artist by the owners of the bank accounts that received the stolen funds.
Dolina reported that she had become a victim of fraud in August last year. The attackers convinced her to sell her apartment in the center of Moscow, and transfer the money received to a supposedly secure account. Polina Lurie, a 34-year-old single mother, became the new owner of the apartment. A criminal case was opened.
