Russians explained the procedure in case of fraudsters applying for a loan


The dean of the HSE Faculty of Law, Professor Vadim Vinogradov, told on Wednesday, March 19, how to act in the event of an unknown loan, probably issued by fraudsters.
According to the expert, first of all it is necessary to contact the bank and the police immediately.
"You can apply on the official website of the Ministry of Internal Affairs of Russia, but it is preferable to visit the department in person. After submitting your application, you will be given a notification coupon, which you must keep. You will need it to track the progress of the investigation. Next, make an application to the bank where the loan was issued. Ask them to conduct an internal audit and suspend the loan agreement," the lawyer explained in an interview with Lenta.Ru .
Vinogradov noted that if the investigation reveals that the loan was indeed taken by fraudsters, many banks release customers from their obligations.
If the bank refuses to cooperate, an appeal should be sent to the Central Bank of Russia through an online reception or prosecutor's office, he stressed.
If the fraudulent loan was issued by a microfinance organization (MFO), then it is worth contacting the self-regulatory organization (SRO), of which this MFO is a member.
Vinogradov added that if none of the above actions helped, a civil lawsuit should be filed.
"Please note that making payments on a disputed loan can be considered as recognition of debt in accordance with Article 183 of the Civil Code of the Russian Federation. Therefore, while the proceedings are underway, refrain from making payments and send a notarized statement of non—recognition of the debt to the bank," the expert concluded.
Earlier, on March 1, a self-locking service for issuing loans and credits was launched on the Gosuslugi website in Russia. Those who have submitted such an application have a special mark in their credit history, in the presence of which banks and microfinance organizations must refuse a person in the case of a loan application. At the same time, the self-ban does not apply to mortgages, educational loans, and car loans.
On March 12, information security expert Alexey Kurochkin told RT about a new fraud scheme related to the loan self-locking service.
