Pension funds can be written off from the debt account through bailiffs or directly through the bank. Oleg Cherkasov, a leading lawyer at the European Legal Service, told about this on March 14.
"The debt itself can have a completely different nature. These can be debts on utility bills, under a loan agreement, taxes, recovery of damage from flooding an apartment or a traffic accident," he said in an interview with the Prime agency.
According to Cherkasov, the write-off is made on the basis of a document sent to the bailiff or directly to the bank where the debtor has an account. In the first case, enforcement proceedings are initiated, and a resolution on foreclosure on monetary funds is sent to the credit institution.
The maximum amount of deduction may not exceed 50% of the amount credited to the account. However, when paying alimony, compensation for injury or damage, it can be increased up to 70%.
"These restrictions apply specifically to the debtor's income, for example, wages, pensions. If a third party transfers funds to a pension card for the purpose of, for example, repayment under a loan agreement, they can withhold the entire amount," the expert said.
At the same time, Cherkasov added that in 2022 debtors have the right to retain income in the amount of at least the subsistence minimum. To do this, you must submit an appropriate application to the bailiff.
Russian Minister of Economic Development Maxim Reshetnikov said on March 5 that 20,000 pensioners were able to write off debts during the simplified out-of-court bankruptcy. He also noted that after bankruptcy was expanded to pensioners and families with children in 2023, from whom debts have been collected for more than a year, a significant part of the appeals began to come from the elderly.
