When using residential premises for doing business, Russians can be fined if it does not meet the mandatory standards and requirements for carrying out certain business activities in residential buildings. Natalia Kostina, lawyer of the Yakovlev and Partners Law Group, told the Prime agency about this on March 11.

It is unacceptable to place offices, warehouses, industrial plants, animal husbandry and breeding, as well as carry out missionary activities in residential buildings, kindergartens and hotels, she added.

"Let's say we're planning a small bread-baking business, a cafe, a real estate agency, a massage parlor, a beauty salon, a private kindergarten, etc. in a residential building. The state establishes clear requirements for the performance of these services, designed to ensure sanitary and hygienic standards, safety, and quality. Most often, the living space in the classic version does not correspond to them," the lawyer explained.

These mandatory rules contain prohibitions for carrying out certain business activities in residential buildings. They also establish requirements for the arrangement of premises, furniture, equipment, ventilation, minimum areas and the number of premises for the sale of goods, the performance of work or services, and so on.

So, according to the specialist, it is possible to carry out activities for the supervision and care of children in residential premises. In this case, the apartment should be located no higher than the third floor, and if children stay in it for more than four hours in a row, catering is necessary, which has a number of requirements.

It is possible to place small-scale production in an apartment, for example, for baking bread, but for this it is necessary to comply with strict requirements for catering and food production enterprises, Kostina noted.

Most often, reconstruction or redevelopment of housing is required to carry out business activities in residential premises. To do this, you need to prepare a draft, coordinate it with the municipal authorities and at a general meeting of the owners of an apartment building. In most cases, it is necessary to obtain a sanitary and epidemiological conclusion, which is impossible if the premises do not meet the established requirements. To provide medical services, you will need to additionally obtain a license.

Administrative liability is provided for violation of the rules for the use of residential premises, including unauthorized reconstruction and (or) redevelopment, and misuse of residential premises. For citizens, the fine ranges from 1,000 to 1,500 rubles; for officials — from 2,000 to 3,000 rubles. An entrepreneur is responsible as an official, she warned.

"The fine is, of course, insignificant, but when using residential premises for other purposes, authorized persons (state or municipal authorities), interested persons (owners of other apartments) have the right to apply to the court with a demand to ban illegal activities," Kostina said.

Citizens who carry out business activities at home are also required to pay for resources and utilities at the rates set for commercial entities.

According to the lawyer, tailoring, needlework, accounting, tutoring, legal and psychological services, including online, are possible with the least risks in residential premises.

On March 6, Oksana Vasilyeva, a lawyer and associate professor at the Financial University under the Government of the Russian Federation, warned Russians about dacha fines in 2025. According to the expert, the main violations are misuse of the land, non-compliance with fire safety rules, waste management rules, sanitary norms and rules of construction and landscaping.
