"Unconquered France" proposed to exclude marital debt from the legislation

The Unconquered France (LFI) party on Friday, March 7, proposed to exclude the concept of "marital debt" from the legislation.

According to the BFMTV television network, the author of the initiative was LFI MP Sarah Legrain. According to her, although the Civil Code of the republic does not explicitly state the need to fulfill "marital duty," the code of laws states that "spouses commit to living together," which can be interpreted by the court as a requirement to occupy a "common bed."

The bill was drafted after the European Court of Human Rights (ECHR) ruled in January on the divorce of spouses from France. The marriage was dissolved on the grounds that the wife had refused to have sexual relations with her husband for several years.

"The court cannot agree that consent to marriage implies consent to future intimate relations, as the government assumes. Such a justification would deprive marital violence of its reprehensible character," the ECHR decision says.

Earlier, on September 8, 2024, it was reported that a bill would be submitted to the State Duma in the coming days on the appointment of a family psychologist's consultation during the divorce of spouses if one of them does not agree to the dissolution of marriage or if the couple has minor children.
