State Duma exempts garbage trucks from fines for overloading

On February 25, the State Duma passed in the second and third readings a bill that imposes a three-year moratorium on overweight fines on garbage trucks. They are also exempted from paying for damage caused by garbage trucks to roadbeds. The document is published on the website of the lower house of Parliament.

According to paragraph 2 part. 1 of Art. 29 of Law No. 257-FZ, it is prohibited to drive on highways without special permits for heavy vehicles (HV), the weight of which with or without cargo and (or) axle load exceeds the permissible mass of the vehicle and (or) the permissible axle load by more than 10%. The bill introduces a moratorium on the effect of this law from April 1, 2025 to March 1, 2028 for vehicles engaged in the transportation of solid waste (garbage trucks).

The explanatory note notes that it is not possible to issue permits, as well as to pay for the damage caused by TCs to highways. The reason is that when loading TKO, the composition of waste (construction waste, branches, waste from housing) and the design of the garbage truck (presence of a pressing unit) do not allow to distribute the transported cargo on the chassis of the vehicle in the required proportions.

By September 1, 2026, the Government of the Russian Federation will establish requirements for vehicles manufactured and used for transportation of solid municipal waste on public roads and their operation. These requirements are to be applied to vehicles put into circulation after March 1, 2028, the text of the bill says.

Now the fine for overloading under Art. 12.21.1 of the Administrative Code is from 250 thousand to 400 thousand rubles, also from the owner of the vehicle is recovered the damage caused to the highway.

On February 19 it was reported that in the Ulyanovsk region approved for implementation a new investment project for the production and sale of trucks and special equipment. It will be realized jointly with a Chinese company, which will be engaged in the supply of machine kits. It is assumed that the chassis will be used for 35 variants of vehicles, including garbage trucks.
