A driver won a lawsuit against the Tambov administration over an attack by a stray dog

For the first time in Russia, a city administration has won a lawsuit over a stray dog attacking a vehicle. Maria Kriventseva fell off her motorcycle in June 2022 while riding along Michurinskaya Street in Tambov. From the tall grass on the dividing strip, a dog ran out at her. Due to the impact, the girl failed to control herself and fell off the motorcycle. Doctors assessed the injuries as a slight harm to health.

Maria Kriventseva filed a lawsuit in court for compensation for damages in a road traffic accident, in which she stated that she considered the damage caused to her - material and moral - to be the result of the inaction of local authorities.

In May 2024, the Oktyabrsky District Court of Tambov partially satisfied Maria Kriventseva's claims and ordered to recover from the city administration material damage in the amount of 52 thousand rubles and compensation for moral damage in the amount of 30 thousand rubles.

The administration of the city of Tambov filed an appeal, in which it asked to cancel the decision of the Oktyabrsky district court, but the court of second instance did not satisfy it.

According to the federal law on the responsible treatment of animals, the authorities of the subjects of the Russian Federation are vested with the duty to implement the procedure for the treatment of animals without owners, the lawyers said.

If the accident was caused by a stray animal, either the local administration or the organization contracted to control such animals is responsible, said lawyer Anna Malafeeva.

Russian legislation stipulates that the responsibility for domestic animals are the owners, and for stray animals - the authorities of the relevant municipality, said the first deputy chairman of the State Duma Committee on Ecology, Natural Resources and Environmental Protection Vladimir Burmatov.
