Lawyer names applicants for plot withdrawal under new law

On March 1, 2025, a law will come into force that defines a three-year period for the development of land located within the boundaries of settlements, garden and horticultural plots. This was reported by Ivan Solovyov, Doctor of Law, Professor, Honored Lawyer of Russia, in a conversation with RT on February 9.

According to him, the law applies to problem plots that are overgrown with bushes and weeds and are in a neglected state. Solovyev noted that the owner has three years to carry out restoration work and use the site for its intended purpose.

In addition, during the time of land improvement, the owner will not be held liable for improper use of the land, because in fact the person has not yet utilized the land for its purposes.

"After the expiration of three years, the owner is liable for non-use of the plot, and control (supervisory) authorities can record violations. It is important that the new law and regulations do not provide for any expansion of the grounds for withdrawal of land plots and do not plan to increase fines for their non-use. They remain the same - failure to use the land plot for its intended purpose for three years," the expert said.

Solovyov said that control measures should be carried out before the withdrawal of the plot. The owners of the land, where signs of non-use have been established, have the opportunity to correct violations in the prescribed manner.

Thus, according to the lawyer's information, under the new rules, the period before the proposed seizure is doubled, as the owner can put the land in order.

Earlier in the day, lawyer Philip Terekhin warned of the risk of seizure of the abandoned plot from March 1. He emphasized that the main purpose of the document is to encourage the right holder to use the plot properly and take care of it.

In December, Izvestia told how large families can avoid getting an unsuitable plot. On the first plot that the family received from officials, it was simply impossible to do anything, as there was a stream flowing there. The woman had to go through two court instances in two years and spend about 100 thousand rubles to prove that this land plot could not be developed.
