The defense of ex-judge Khakhaleva intends to achieve the termination of her criminal case

The defense of ex-judge of the Krasnodar Regional Court Elena Khakhaleva intends to achieve the termination of the criminal case against the defendant. This was reported to "Izvestia" on February 5 by her lawyer Yaroslav Krasnoshchekov.

According to the investigation, in the period from 2016 to 2019, Khakhaleva was absent from her workplace for 127 days, but, deceiving employees, continued to fill out timesheets. For this she illegally received 1 million 195 thousand rubles in salary. The Investigative Committee (IC) of Russia saw signs of forgery in the entry of false information in the timesheets.

Krasnoshchekov noted that the defense disagrees with the qualification of the crime. He believes that if the investigator can prove the willful nature of the woman's actions, she will be charged with Article 165 of the Criminal Code ("Causing property damage by deceit or breach of trust"). In his opinion, Khakhaleva's actions are thus seen as "negligence", i.e. non-performance or improper performance by an official of his duties.

At the same time, there is no corpus delicti as "official forgery" at all, as the time sheets were signed collegially, the lawyer believes. He added that he had already filed the appropriate complaints.

Krasnoshchekov also noted that he has no information about the extradition of his client to Russia. In addition, he noted that there is no damage in the criminal case of the former judge.

Earlier, on January 27, Khakhaleva was detained at Baku airport. According to the source of "Izvestia", the woman wanted to fly to Dubai, but she was removed from the flight. A package of documents on her charges in the Russian Federation has been requested from the Russian side. After receiving the appropriate response, Azerbaijan should make a decision regarding the defendant, including the extradition procedure.

On May 17, 2022, a criminal case was opened against Khakhaleva under articles on fraud and official forgery. The Investigative Committee suspected the judge of embezzlement of 1 million rubles. June 10, she was arrested in absentia and put on an international wanted list. She was chosen a measure of restraint in the form of two months of arrest from the moment of actual detention.

Khakhaleva became known in the media as a "golden judge". In 2017, it became known about the wedding of her daughter for $2 million, at which the stars of Russian show business performed. At the same time, it later turned out that Khakhaleva could not hold the position of a judge, as her diploma turned out to be fake. Documents confirming the woman's studies at the Abkhazian university could not be found. The plenum of the Supreme Court of the Russian Federation removed Khakhaleva from the presidium in the fall of 2018, and in the summer of 2019 she was suspended from trials.

In July 2020, the Supreme Qualification Collegium of Judges (VKKS) of Russia prematurely stripped Khakhaleva of her powers.

On December 8, 2021, she left Russia, flying to Yerevan. She left behind real estate estimated at 300 million rubles, but managed to sell a house for 85 million rubles.
