From February 5, a new procedure for issuing a certificate of right to inheritance by notaries will take effect. This was announced on Tuesday, February 4, by lawyer, head of the center of law enforcement in Moscow and Moscow region Alexander Khaminsky.

"Now the notary when issuing a certificate of right to inheritance, in order to verify the fact of state registration of the death of the testator, as well as the presence of kinship relations, which are the basis for calling a person to inheritance, must request the relevant information through the system of maintaining the Unified State Register of civil status records", - he told in conversation with "RIA Novosti".

At the same time, Khaminsky noted that such a check will not be required only if the notary will be presented to the documents drawn up abroad with the participation of competent authorities, confirming the fact of state registration of the death of the testator.

According to the lawyer, the new procedure should simplify the process of confirmation of kinship to heirs, as well as reduce the number of legal disputes about inheritance.

Earlier, on April 1, 2024, a teacher of the Department of Legal and Social and Humanitarian Disciplines of the University "Synergy", lawyer Anton Paliulin called the way to enter into inheritance without a will. The specialist noted that for this purpose it is necessary to perform a sequence of actions provided for by the Civil Code of the Russian Federation and the Fundamentals of Legislation of the Russian Federation on Notariate.
