The Constitutional Court has protected the right of Russian citizens to compensation for treatment outside the compulsory medical insurance system

The Constitutional Court of the Russian Federation has protected the right of Russians to receive compensation for the costs of medical treatment which was carried out outside the compulsory medical insurance program. The corresponding ruling was published on January 31 on the website of the Constitutional Court of the Russian Federation.

"To recognize paragraph 1 of Article 1085 of the Civil Code of the Russian Federation <...> does not provide grounds for refusal to reimburse reasonable and justified expenses incurred for treatment by a person who could have received treatment of health damage for free under the compulsory health insurance program, but chose paid treatment," the ruling says.

It is specified that the complaint to the Constitutional Court was filed by Russian Roman Romadanov, who had his jaw broken during tooth extraction in Vladivostok dental clinic. In connection with the injury, the man was treated in the city hospital, where metal plates were inserted, which Romadanov paid for himself, because they were not included in the OMC.

At the first stage, the court ordered the dental clinic to pay the man damages resulting from improper treatment, as well as to pay the costs of the plates. But due to an appeal filed by the clinic, some points of compensation were overturned, including payment for the plates, because the patient, according to the dental clinic, could have received free treatment under the OMC without the use of titanium plates.
