You can buy a new apartment not only from a developer, but also from an individual. However, not always the seller of an apartment behaves honestly. On December 28, Anna Dyagileva, an expert in residential real estate, private realtor, told Izvestia about how not to lose money.

"There are a number of important points that you should definitely pay attention to in order to check the seller, the apartment and the correct closing of the transaction. So, in the case of an assignment transaction, when not the apartment itself is sold, but the right of claim for it from the developer upon delivery of the house, it is extremely important to pay attention to the fact that this object was formalized and bought exactly under the equity participation agreement (CDA). In addition, the money should be credited only to the escrow account without cash transfer or crediting to any third-party bank account," the expert explained.

According to her, in case the money is in an escrow account, it will be returned to the buyer even if the developer does not complete the object. In the case of an assignment transaction, the buyer is also assigned the right to that escrow account.

"However, remember that if you, for example, agreed to specify in the assignment agreement one amount, and bought for a large and nowhere documented it is not fixed, then, most likely, to return you will receive only the amount that was exactly on the escrow account," - said Dyagileva.

In addition, you should be sure to check whether the seller of the desired real estate object (in the transaction by assignment or under the contract of sale) is not in pre-bankruptcy. This is important because if the seller files bankruptcy soon after the sale of the apartment, it may become the subject of disputes or claims from his other creditors.

"The next point is to check the seller's marital status, namely whether the person is married at the time of the assignment agreement, and if so, whether there is spousal consent to the transaction. If you assign the object without the consent of the spouse, then in the future this deal can be challenged," - said the realtor.

According to her, one important point is to check the capacity of the seller: the absence of registration in a psychiatric, psychoneurological or narcological dispensary. This is no less important, because in the case of registration of a person on the record, this transaction on the assignment can later be challenged. The same applies to the purchase of housing in a new building from an individual who took this apartment into ownership.

"In the case of buying an apartment from the owner, it is also very important to check that the settlement with the developer has been made in full, and that all acts of mutual settlement have been signed and there are no debts owed to the developer. The same rules work in the assignment transaction", - emphasized Dyagileva.

If the apartment is bought by assignment, which provided for installment payments or mortgage lending, it is necessary to make sure that all payments were made according to the payment schedule, said the expert.

If this condition was violated, then at least you need to contact the developer and find out what sanctions they plan to impose on the seller for delays. This applies especially to the purchase of real estate in installments: if, for example, a person had to pay the amount in a certain period of time and did not pay it, it is likely that penalties will be charged. And it is very important for the buyer to make sure that he will not receive a future demand from the developer to repay these installment payments within a certain period of time and pay additional penalties.

"Finally, if the apartment in the new building has already been transferred into ownership, it is important to check two more things: whether there are no any encumbrances or arrest on it; whether the apartment is not registered in the apartment anyone on a temporary or permanent basis - for this purpose it is necessary to request an extract from the house book or a certificate that no one is registered at the address, because there are risks on the part of people registered in the apartment, as registration implies the right of residence," - explained Dyagileva.
